BIC® Art Master 2024

These terms include the Schedule and Terms and conditions attached hereafter and     apply to the BIC® Art Master Africa 2024 Competition. BIC Privacy Policy and Cookie Policy shall apply to these terms (collectively referred to as the “Terms”) and by submitting an entry, each participant agrees to comply with these Terms.

Competition Schedule

In the event that the winner’s original artwork is found to be plagiarised, copied or replicated or found to be unoriginal in any manner whatsoever, BIC shall reserve the right to revoke and cancel the winner announcement as also seek to recover the winner’s prize money and other reasonable cost and expenses including legal fees and indemnification for settlement of any claims made in respect of the winner’s artwork. By entering into this Competition, the entrant unconditionally and irrevocably consents to indemnifying BIC against any actions, claim made against the submitted artwork.

Entry Restrictions

Entry is open to all Africa and Middle East residents aged 13 years or older. Entrants under 18 years of age must have the consent of a parent/ guardian to enter. Further, the parent/guardian of the entrant must read and consent to the Terms. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor participating in this this competition. All warranties and agreements provided in the Terms by an Entrant are also deemed to be provided by the parent or legal guardian of such an Entrant if the Entrant is a minor

Competition Period

The Competition Period starts at 12:00 am GMT Tuesday 02-APRIL-2024.

The Competition closes at 11:59 pm GMT Tuesday 02-JULY-2024.

No entries will be accepted after this time

Verification Requirements

Entrants should ensure that content is original, authentic and the rightful property of the entrant. It is a condition of entry that the prize winner agrees for their name to be published for marketing purposes anywhere in the world in any format

Entry Procedure

Entrants are required to create a large scale (no smaller than A3) piece of art using only BIC® Ball Pen. Once an entrant has completed an art, art can be submitted through the Competition Platform.

Entrants can submit 3 entries that are substantially unique and submitted separately in accordance with these Terms

Judging Panel

Judges : A panel of judges is selected by the Promoter

The judges will judge each entry based on the Winning Criteria as set out below. The judges’ decisions shall be considered final, binding, not appealable, subject to challenge or review and no correspondence will be entered into. BIC®, and their agents will not be held responsible for any disputes arising from the competition or prize rewarded

Winning Criteria

BIC Art Master of Africa Prize Winner: is the First-place winner of the Competition who will be picked by the Judging Panel based on (1) originality, (2) creativity, and (3) eloquence. A single winner will be selected.

Second Place Prize Winner : is the second-place winner of the Competition who will be picked by the Judging Panel based on (1) originality, (2) creativity, and (3) eloquence. A single winner will be selected.

Third Place Prize Winner : is the third-place winner of the Competition who will be picked by the Judging Panel based on (1) originality, (2) creativity, and (3) eloquence. A single winner will be selected.

  • National Winner of Country :is the local winner of the Competition in any one of the participating countries, who will be picked by the Judging Panel based on (1) originality, (2) creativity, and (3) eloquence as Art Master of the country. A single winner will be selected from the following countries: Morocco, Nigeria, South Africa, Kenya, Uganda and Ivory Coast.

Lucky Voter Prize Winner : is a single winner that will be picked randomly from all Facebook users who will share any of the top 10 artworks on their profiles. during after the competition ends using their unique IDs that will be put into a randomizer application to pick a single winner.

The winners will be requested to submit the original artwork to the Promoter to verify originality and the ownership or the Promoter will arrange for the artwork to be collected from the finalists within 15 working days.

Winners announcement

Winners will be announced by 15 September 2024.

Prize Conditions

BIC Art Master of Africa receives 2,000 USD cash prize, personalized virtual gallery developed by BIC for the winner (to manage, upload the winning artwork for 1 years) and possibility of getting the artwork featured in La BIC collection of Art by purchasing the artwork.

Second Place Prize Winner : receives 1,000 USD cash prize only.

Third Place Prize Winner : receives 500 USD cash prize only.

National Winner of Country : receives 500 USD cash prize only.

Lucky Voter winner receives prize valuing 250 USD

Prize Restrictions (if any)

If a winner of a prize is under the age of 18 years, the Promoter may, at its discretion, award the prize to the winner’s parent or guardian.

Notification of Winners

The Promoter and/or their advertising agents will contact the winners ONLY, via telephone or email. Winners who are not contactable by telephone within 48 (forty-eight) hours after the Closing Date will be disqualified and the prize will be forfeited. The Promoter reserves the right to select reserve entries and record them in order of merit in the case of an invalid or ineligible entrant.

Consents

The information entrants provide will be used by the Promoter for the purpose of conducting the Competition. The Promoter may disclose entrants’ personal information to its affiliates, companies and agencies connected with this Competition and to relevant authorities, and the winner’s name and name of residence may be published in accordance with these Terms and as required under laws. Each winner consents to BIC® publishing his/her name/s, photograph and the entry including derivative works thereof and any reproduction of them in any form in any media whatsoever, whether now known or hereafter created, throughout the world in perpetuity.

Competition Terms and Conditions

The Schedule prevails to the extent of any inconsistency with these Terms and Conditions. Participation in the Competition constitutes acceptance of these Terms. Any capitalized terms used in these Terms have the meaning given in the Schedule, except where stated otherwise. Entry into the Competition implies the acceptance of these Terms and Schedule of the Competition.

Eligibility

  1. The competition is open to all African and Middle East residents except directors, members, partners, employees, agents, service providers and consultants of BIC as well as their immediate family members, business partners and associates (referred to as the Promoter). “Immediate family members” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.

 

Entry

  1. The Competition will be conducted during the Competition Period.
  2. To enter the Competition, entrants must complete the Entry Procedure during the Competition Period.
  3. Entries may only be submitted in accordance with the Entry Procedure and will not be accepted by the Promoter in any other form. Once submitted, entries may not be altered or deleted.
  4. Multiple entries are permitted and must be submitted separately, and must each separately meet requirement specified in the Entry Procedure.
  5. Entries must be received by the Promoter during the Competition Period.

 

Entry Content

  1. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Terms. For the purposes of these content requirements, “entry content” includes any content that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the Competition.
  2. Incomplete and ineligible entries will be deemed invalid. Entries will also be deemed invalid if they breach these Terms as determined by the Promoter in its sole discretion or any other content guidelines notified by the Promoter during the entry process for the Competition.
  3. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work.  If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid.
  4. An entrant’s entry must not include:
  5. any image of any other person without that person’s express consent.  Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;
  6. any content that contravenes any law, infringes the rights of any person or is obscene, offensive, potentially defamatory, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and
  7. any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which intellectual property rights such as trademark, or copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these Terms.
  8. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry.

 

  1. As a condition of entering in this Competition, the entrants as authors exclusively assign to the Promoter all proprietary rights with respect to their content, photo or entry (“Work”), including the rights of representation, reproduction, scanning and adaptation of it for whatever purposes (commercial and or non-commercial purposes), without compensation, royalty, attribution or liability. This assignment transfer is granted for worldwide operation, for the maximum legal term of the copyright protection and its assigns. The Promoter may freely reproduce and adapt and modify the Work or extracts of it by any existing or incoming process of material fixing on any support, in any format and may freely distribute, represent or have the work be represented to the public by any means, for any direct or indirect means. This assignment of his rights is granted by the entrant to the Promoter free of charge. Each entrant warrants to the Promoter full enjoyment of the assigned rights against any trouble, claim or any eviction and undertakes not granting of any transfer of rights to third parties on its Work.

 

 

 

Claiming prizes

  1. Prizes must be claimed by the Prize Claim Date in accordance with any claim instructions set out in the Schedule.
  2. If a prize is not accepted or claimed by the Prize Claim Date, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the unclaimed prizes to the next best ranking entry or entries (as applicable), as determined by the Promoter in its sole discretion.

  1. If you consider any content published on the Platform that violates these Terms,  we appreciate that you inform us by clicking the “Report Abuse” on the Contribution section. Our team will be then automatically notified and will follow up. If you consider that the deletion of one of your entries is not justified, you can contact digital@Bicworld.com.

 

Governing Law

  1. The Governing Law of this Contest will be French laws and each Participant agrees to the exclusive jurisdiction of courts in Paris for any disputes relating thereto.

 

Miscellaneous

  1. The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) any costs incurred including without limitation with respect to travel or expenses related to sending the artwork to the Promoter.
  2. The Promoter may, at its sole discretion, declare any or all entries made by an entrant invalid, and prohibit further participation by an entrant in this Competition, if the entrant:
  3. fails to verify their personal details and/or eligibility to enter the Competition to the Promoter’s satisfaction;
  4. tampers with or benefits from any tampering with the entry process or the operation of the Competition;
  5. submits an entry which in the Promoter’s opinion is not in accordance with these Terms;
  6. acts in a disruptive manner or with the intent to annoy, abuse, threaten or harass any other person; or
  7. engages in conduct in entering the Competition which in the Promoter’s opinion is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. This includes where entrants share receipts or product labels to enter the Competition or where entrants use multiple names or addresses to register multiple entries.
  8. Entrants must comply with the Verification Requirements. The Promoter may require entrants to provide these to the Promoter or its agent as part of the entry verification or prize claim process.  Failure to provide these to the Promoter’s satisfaction will result in the relevant entry being declared invalid (and, at the Promoter’s discretion, in all of the entrant’s entries being declared invalid).
  9. All entries will be the property of the Promoter and will not be returned.
  10. Prizes are not transferable or exchangeable. The value of each prize is accurate as at the time of preparation of this material. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if any prize (or any part of a prize) is unavailable for any reason.

 

  1. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the general law, as well as any other implied warranties or similar consumer protection laws in Africa (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
  2. If for any reason any aspect of this Competition does not or is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of the relevant authorities, if required.
  3. The Promoter’s decisions in connection with the Competition are final and no correspondence will be entered into.
  4. The Promoter, its associated agencies and companies and the agencies and companies associated with this Competition will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  5. The Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of prizes.
  6. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.
